Trainings or certification programmes

These Terms of Use govern the relationship between you and Tyk Technologies Ltd & its affiliates (“Tyk”) in relation to your participation in, and contribution to, one of Tyk’s training or certification programmes (“Tyk’s Training Programme”).

1. Acceptance

By participating in a Tyk Training Programme and/or accepting these Terms of Use, you agree to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from participating in Tyk’s Training Programme, alongside accessing and/or using any associated programme materials (“materials”). The materials are protected by applicable copyright and trademark law, in Tyk’s favour.

2. Use

Any materials shared or accessed by you are licensed to you on a personal, revocable and limited basis, for non-commercial viewing use only. You must not, without limitation:

modify or copy the materials;
use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
attempt to decompile or reverse engineer any software contained on Tyk’s website;
remove any copyright or other proprietary notations from the materials; or
transfer the materials to another person or ‘mirror’ the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Tyk at any time. Upon termination, you must destroy any materials in your possession whether in electronic or printed format.

3. Feedback

Tyk’s confidential information and all intellectual property rights in, and to, Tyk’s Training Programme and materials will remain the property of Tyk.

You agree that any suggestions, ideas, feedback, proposals, content or other material provided by you in connection with Tyk’s Training Programme (collectively, “Feedback“), shall be deemed to be not confidential and non-proprietary. Tyk shall not be liable for the disclosure, use or transmission of any Feedback. You hereby grant to Tyk a worldwide, non-exclusive, perpetual, irrevocable, royalty-free and transferable right and licence to incorporate, use and/or publish the Feedback for any purpose whatsoever, commercial or otherwise, without compensation or accounting to you or any other third party. For the avoidance of doubt, Feedback will not include your personal identifiable data.

4. Data Protection

You and Tyk agree to comply with all applicable data protection laws.

5. Limitations

The materials and Tyk Training Programme are provided to you on an “AS IS” basis and Tyk gives no representations, warranties, conditions or other terms of any kind in respect of it, whether express or implied, including (but not limited to) warranties of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement.

You agree that Tyk shall not be liable for any losses or damages arising out of, or in connection with, Tyk’s Training Programme or the materials, save for any liability that cannot be excluded by law (which shall be limited to the minimum extent permitted by law).

6. Revisions

Tyk’s Training Programme and materials may include errors – including, without limitation, technical, typographical, or photographic errors. Tyk does not warrant that any of the materials are accurate, complete, or current. Tyk may make changes to the materials at any time without notice. Tyk does not, however, make any commitment to update the materials.
